Terms and Conditions

Payment: All equipment remains the property of Caterlink until payment has been received in full and all monies have been cleared or deposited into the nominated Caterlink bank account. A 40% deposit may be required to secure a special order item with Caterlink; one of our consultants will contact you within 48 hours to confirm details. Stocked items ready for immediate dispatch require payment in full prior to shipping/collection. This is inclusive of any incurred freight charges. Caterlink will not accept trading accounts for online sales. Credit card payments must be submitted in full - including the CCV number - in order to prevent fraudulent transactions. Purchase price does not include unpacking, placement or positioning of equipment or installation, connection to services or removal of rubbish, packing or existing units. All prices are GST exclusive and will be calculated at order totalling.

Caterlink accepts MasterCard, Visa, Bank Card, cheques or payment directly from your bank account in AUS dollars. We do not accept American Express, Diners Club or international wire transfers.

Stock Availability: Some items may not be in stock at the time of placing order. One of our sales consultants will contact the purchaser within 48 hours to confirm delivery times and stock availability. Lead times for goods are varying from 1-2 days up to 6-8 weeks on special order items or at times of high volume.

Cancellations: orders may be cancelled under the following conditions.

a) That the cancellation is received before any goods that are specially ordered begin manufacture. If not, the purchaser will be responsible to take delivery for the goods and pay in full. Should the purchaser refuse to accept the goods, any deposits or monies paid will be forfeited by the purchaser. There is no return on custom-made goods.

b) If the equipment is a stocked item, cancellation must be received one week before shipping. Caterlink will not accept cancellation on the day that goods are sent or collected by carrier; this will not be considered or accepted as sufficient cancellation notice and the purchaser will be liable to take possession of the goods. A cancellation/restocking fee will apply being a minimum of 20% of the purchase price for any goods incorrectly ordered. No cancellation on special order items.

Terms of Delivery: Caterlink will determine the appropriate freight company based on the order and the client's geographical position. All deliveries organised by Caterlink on behalf of the purchaser are to kerbside only. Unless previously organised with a Caterlink sales consultant, further charges may apply. It is the purchaser’s responsibility to notify Caterlink of all relevant site information in the event of additional freight services being required by Caterlink (for example, stairs, access issues, etc). The transportation carrier has the right to refuse delivery upon arrival should misinformation preventing them from being sufficiently equipped to deliver on site. In this occurrence, the additional charges will be forwarded to the client due to lack of or misinformation being provided. Caterlink does not take any responsibility for any losses arising from any damage incurred in transit when freight is organised by the purchaser. Installation/connection to services is not included in delivery costs and if required will need to be pre-arranged with Caterlink prior to shipping. If possible, Caterlink will present a quotation or contact details of a preferred installer in the purchaser area.

Delivery Dates: All delivery dates as supplied on invoices are approximate only. Caterlink endeavours to deliver goods on time to all clients, however are not responsible for any delays that arise from any 3rd parties. Caterlink cannot guarantee exact delivery dates as it is subject to any transportation issues that can arise prior to delivery. Caterlink will also assume no responsibility for delays that may occur as a result of related industrial disputes, accidents, fires, natural disasters, wars or non delivery of parts/goods by suppliers or reason beyond Caterlink’s control.

Return of Goods: The return of goods for credit must be arranged with Caterlink, transport costs being the responsibility of the customer. All goods returned due to change of mind will not be refunded and a credit note will be issued minus a restocking fee as determined by Caterlink after inspection of the returned unit (minimum 25% of restocking fee). Goods must be returned in original condition with packaging, warranty cards and instruction manuals. If the returned item has been used in any way it will not be accepted by Caterlink and no credit will be issued. All goods to be returned must be arranged with Caterlink in advance and only at Caterlink’s discretion can items be returned to store for credit. Please note that there are No Refunds.

Damaged Goods: If an item is received damaged or faulty in any way, you should immediately notify Caterlink by phone, fax or email listing your contact name, address, phone and fax numbers, an invoice number and details of the fault. Caterlink will contact the manufacturer immediately in order to rectify any faults under warranty. All delivery dockets and consignment notes must be kept and submitted to Caterlink for claims against transport companies. It may be necessary to forward photographs by form of email or post in order to assess damage to goods.

Insurance: Insurance for goods in transit is not included in the purchase price. If insurance is required please notify Caterlink immediately as a quotation will need to be arranged before shipping.

Warranty: All items are covered by the manufacturer’s standard warranty. These items are listed on the manufacturer’s site. Caterlink can confirm any warranties prior to purchase. Smaller items may be on a back to base warranty. Please read carefully when purchasing items. Caterlink manufacturer’s warranty does not cover any perishable products lost due to the fault of any item sold. If an item is at of warranty the customer is liable to pay any further charges incurred after the date of expiration. Warranty can be voided if customers tamper or have a 3rd party service or repair any faults that may occur during the period of warranty without written approval from the manufacturer. If this is the case, the customer will be fully responsible for the item once the warranty is voided. Warranty servicing of units is covered during normal business hours (9am-5pm in most cases). Servicing required outside of these hours will incur charges to the purchaser.

Acceptance of Sale: By placing an official order with Caterlink acknowledges that you as the purchaser agree to all of our terms and condition of sale as listed above. Please contact Caterlink direct should you have any further enquiries prior to ordering any goods. 11. Exporting of Goods: At present, Caterlink is not exporting online sales out of Australia. Error Disclaimer: While all care is taken, incorrect prices posted in error will not be honoured. Contact us at the time of ordering to ensure all prices are still present and correct.

 

Return of Goods: Depending on the price of the product and its intended use, you may have statutory rights that are designed to protect you. Caterlink's terms and conditions do not modify or exclude any condition or warranty implied or any liability imposed by any Australian law (including the Trade Practices Act 1974) if to do so would contravene the law or make any other part of these terms void. Statutory rights and warranties will generally apply if the supplied goods are defective, do not match the description provided, are not fit for the described purpose, or are not of merchantable quality etc. They do not apply when you simply change your mind, or where you cause damage through misuse or lack of maintenance of the product etc.

Where the circumstance regarding the return of goods are not expressly provided for under applicable statutory rights, the acceptance of the return of goods is at the sole discretion of Caterlink.
In these circumstances refunds will not be provided and any return of goods must be confirmed in writing with Caterlink prior to their return, and arrive at Caterlink's premises,

  • unused
  • in original condition
  • with all manuals, accessories and attachments,
  • in original packaging or packaging suitable and appropriate for the product,
  • with transport costs being the sole responsibility of the customer.
Where Caterlink agrees to accept goods returned under these circumstances a credit note may (at the sole discretion of Caterlink) be issued minus a restocking fee determined after inspection (minimum 25% of purchase price). Nothing in these circumstances compels or obligates Caterlink to accept any such return of goods in whole or part.
